Virginia Democrats float prosecution, National Guard deployment if police don't enforce gun control

Kerry Picket
December 11, 2019

Democratic lawmakers on Capitol Hill say local police who do not enforce gun control measures likely to pass in Virginia should face prosecution and even threats of the National Guard.

After November's Virginia Legislature elections that led to Democrats taking control of both chambers, the gun control legislation proposed by some Democrats moved forward, including universal background checks, an “assault weapons” ban, and a red flag law.

Legal firearm owners in the state, however, joined with their sheriffs to form Second Amendment sanctuary counties, which declare the authorities in these municipalities uphold the Second Amendment in the face of any gun control measure passed by Richmond.

Over 75 counties in Virginia have so far adopted such Second Amendment sanctuary resolutions in the commonwealth, the latest being Spotsylvania County. The board of supervisors voted unanimously to approve a resolution declaring that county police will not enforce state-level gun laws that violate Second Amendment rights.

Virginia Democratic officials, however, already say local law enforcement supporting these resolutions will face consequences if they do not carry out any law the state Legislature passes.

“I would hope they either resign in good conscience, because they cannot uphold the law which they are sworn to uphold, or they're prosecuted for failure to fulfill their oath,” Democratic Virginia Rep. Gerry Connolly told the Washington Examiner of local county police who may refuse to enforce future gun control measures. “The law is the law. If that becomes the law, you don't have a choice, not if you're a sworn officer of the law.”

Democratic Virginia Rep. Donald McEachin suggested cutting off state funds to counties that do not comply with any gun control measures that pass in Richmond.

“They certainly risk funding, because if the sheriff's department is not going to enforce the law, they're going to lose money. The counties' attorneys offices are not going to have the money to prosecute because their prosecutions are going to go down,” he said.

McEachin also noted that Democratic Virginia Gov. Ralph Northam could call the National Guard, if necessary.

“And ultimately, I'm not the governor, but the governor may have to nationalize the National Guard to enforce the law,” he said. “That's his call, because I don't know how serious these counties are and how severe the violations of law will be. But that's obviously an option he has.”

Virginia Attorney General Mark Herring blamed the numerous Second Amendment resolutions in the state on the “gun lobby” as a tactic to frighten state residents.

“The resolutions that are being passed are being ginned up by the gun lobby to try to scare people. What we’re talking about here are laws that will make our communities and our streets safer,” Herring told CBS 6.

“So, when Virginia passes these gun safety laws that they will be followed, they will be enforced,” he added.

Instead of resorting to bureaucratic threats, Virginia Democrats should take this opportunity to listen to their constituents and reevaluate this initiative. The fact that so many counties have opposed the legislation is telling: 75 of Virginia’s 95 counties have now declared themselves Second Amendment sanctuaries, along with nearly 40 independent cities.

Democrats might have won both of the state’s legislative chambers in November, but they still govern a people largely divided on the issue of gun control. As of October, 47% of Virginia voters supported candidates in favor of gun control, and 44% opposed them. That’s a tight margin, which means Democrats cannot afford to ignore the other half of the debate if they hope to keep their majority for long.

Northern Virginia counties situated in the Beltway decided November’s election, but they should not be allowed to dictate which rights the rest of the state can and cannot enjoy. Individual counties should have the right to protest this law without fear of retaliation, and the state’s legislature would be wise to listen.

They had better tread lightly as this could get way out of hand real quick. When you start to see people traveling to Virginia and talk about standing up for they’re rights, then it’s “shot heard around the world” time. There’s a lot of people who are not in a complying mood when it comes to giving up they’re rights under the constitution. There’s even more people itching for a fight and ready to push out those that think the way these grabbers do.

The left has wanted a war; it would be appropriate for it to start in VA,

well.....between the republican candidate in FL that wants to hang liberals.......and democrats in VA that want to call the nat; guard for gun confisication......a grand standing democrat House in d.c putting on a dog and pony show for impeachment, counties now in Texas also declaring themselves 2a sanctuary locations while the houston police chief calls for gun control,...........

the doomsday clock for civil unrest probably reads at 20 till..........i honestly expect some "prepping" that will consist of some "planning"......when there is one shove too many, the carnival barkers become passionate preachers of unrest, and one side gets tired of trying to shout down the other side and resorts to force........................expect some lone wolf activity followed by a re-birth of squad-size radical violent elements from both sides......

a re-birth with individual and group tactics similiar to E.L.F., Weather Underground, timothy mcveigh bombing, los vegas mass shooting, etc, etc.........except the targets will be more political.....and viewed as patriotic as long as republicans, democrats, gun supporters, etc are targeted......

".......... cutting off state funds to counties that do not comply with any gun control measures that pass in Richmond."

".......... cutting off Federal funds to counties, cities, states that do not comply with Gun Ownership Rights as stipulated in the U.S. Constitution, 2nd Amendment."

You'll notice that all of these Constitutional Rights trespasses and offenses are originating with DEMOCRATS. The DEMOCRAT Party is a Communist, criminal organization.

Push back and "pay back" from the armed citizenry could be a "biotch" for DEMOCRAT politicians and party functionaries. How insane are they to think that our "citizens" in National Guard uniform become mindless, obedient Nazi SS who will willingly and with zeal, oppress their fellow law-biding citizens. They, the DEMOCRATS, are so stoopid they think the regular U.S. Army soldier will blindly and obediently do their political bidding, as well.

DEMOCRATS are cunning, evil, mischievous and treacherous. Fortunately they are also delusional and detached from Reality and the normal, sane citizens. That's what got Hillary booted and Trump elected.

I see a few problems with sending in the National Guard.

First, they don't have jurisdiction to handle cases of, or against a soveriegn state or commonwealth, do they ?

Second, what guarantee does Virginia have that Trump, the C in C of ALL armed forced in the US, will authorize sending in the National Guard ?

Sending in the National Guard, on behalf of the State of the Commonwealth of Virginia, to negate the National Constitutional Rights of Virginia Citizens simply sounds like an empty threat.

How can a state possibly order the National Guard to violate a citizen's NATIONAL Constitutional rights ?

Just whom do they imagine makes up the Virginia National Guard? They are not soy-boy hipsters and shrill androgynous womyn acting as revolutionary guards for the ayatollahs in Richmond. The tone-deafness of the Dems is noteworthy.

He might be better of not doing anything just to show everyone how the dems really are. Many already know but when they see scenes on the news that resemble nazi Germany it may change the minds of others. The dems are really losing it!

These idiotic politicians have forgotten that the Virginia National Guard is composed of Virginian Citizens, many of them, if not the majority, are from those same counties that have enacted 2nd Sanctuary laws. I do not think the the governor will have much success by calling the National Guard.

This isn’t even getting any airtime on the news. This will be a clear violation of the constitution in the 2nd and 4th amendments. A judge will grant an injunction and stop any of this.it ill then go to court and start climbing the judicial ladder and may wind up at the SCOTUS. I truly wish it would and it an end to this BS. I hope cooler heads prevail or this will turn to bloodshed. There’s a lot of guys just itching to get into this fight from all over the country. Force will not stop them from defending their rights.
