The only problem will be getting enough votes for cloture. I doubt there are 7 Dems willing to cross the aisle.We are now less than a year before an election. The republicans stopped the nomination of Garland for this reason. If they put through a justice now, there will be problems.
That was before the "rule change" for confirming a SCOTUS justice. Before change in the rule to confirm a justice, there had to be a 2/3rds majority to confirm, now the rule is a simple majority to confirm. Republicans have enough votes to confirm the next SCOTUS justice, and could conceivably lose the Senate to Democrats in the 2020 election, so there is no advantage for Republicans to hold off on confirming a new justice. Ginsburg, 86, has been released after being admitted with chills and a fever, a spokesperson for the Supreme Court said on Sunday.
She was admitted to Johns Hopkins Hospital in Baltimore on Friday night after an initial evaluation at Sibley Memorial Hospital in Washington, the court official said. She was transferred to the Baltimore facility for evaluation and treatment of a possible infection.
With intravenous antibiotics and fluids, her symptoms abated, the spokesperson said Saturday.
The hospitalization followed her return to the bench Monday after missing a day of arguments the previous week.
Last week, she was "home with a stomach bug," a court spokesperson said.
Ginsburg was treated over the summer for a cancerous tumor on her pancreas, and she underwent surgery last winter for lung cancer.
She has vowed to stay on the Supreme Court, which is staffed by lifetime presidential appointments, as long as her health permits.
