Hey guys, so I bought a handgun on Monday here in Arizona. Purchased and completed the paperwork, ready to walk out of the shop and the guy tells me that there is a delay in my application. He couldn't tell me why and I never had a problem with this before. He tells me that I can come back in five business days to pick up the weapon if I do not hear from him. I purchased a shotgun in my hometown in Wisconsin when I turned 18 and no problems at all. I am now 23 and started thinking what could get me denied for this. In September of 2013 I got a Class B Misdemeanor for DUI, no probation, paid all fines, and got a three month suspension on my drivers license. In August of 2011 I got a Class B Misdemeanor for Trespassing, which I completed my probation and paid off all fines. I never had a felony charge against me nor do I intend to get one...ever. I was in the Arizona Army National Guard for three years till I tore my ACL and I received a medical discharge in 2013, not dishonorable. Although, my father and grandfather have the same first and last name as I and both had previous felony charges against them many, many years ago. I thought it could be that but between my father, grandfather and I we have different middle names and different SSN (obviously). So some may assume I would be fine to complete this purchase with no hassle, but for some reason I am worried I will get denied for this.

So my question is this: Is there a chance I can be denied to complete this transfer?

Don't sweat it. Things like this often happen. Wait the five days and go pick up your handgun.

If you have a "common" name, you'll have a higher chance of having any firearm purchase scrutinized, to make sure you are you and not a felon with the same name.

You drove drunk and think it's all OK again after serving your probation? You come from a family with a two generation criminal record? The latter shouldn't matter by itself, you can't be held responsible for your father's and grandfather's actions, but added to the former my personal alarm bells are starting to ring.

I have to say I'd want to think twice before handing you a gun. I'm not saying you'll be denied, but there are certainly blots on your copy book that merit closer examination than the average Joe with a clean record.

That happens to me all the Time, you can get on the NICS and do a appeal, if they approve it they will assign you a Pin # to present when purchasing a new gun and you won't have to wait. However I have not done this yet but have attached the link.

FBI ? Gun Checks/NICS

It's not my judgement that matters, is it?

I don't have a lot of time for drunk drivers, and this young man hasn't improved his chances of being trusted with a firearm (in my opinion) by making the decision to endanger other people's lives by DUI.

I had trouble here in TN
They never would tell me what the problem was just that my DD214 was out of order.
Every time I went to purchase I had to go thru the circle of 30 days to determine.
So I went to digging and discovered I had failed since 1980 to register my DD214 with the courthouse.
I dug out my DD214 registered it at the courthouse and have had no further delays.

Just because he got a DUI doesn't mean he isn't responsible with firearms, irresponsible with alcohol Maybe, but he could of learned his lesson also. People do learn from their Mistakes (some):thumbsup:

You're only half correct. Irresponsible with alcohol while driving = irresponsible with firearms (and any other potentially deadly item). On your second point, yes, he may have learned from his mistake.

Gentlemen.

A DUI, misdmeanor trespassing charges and a family history of felonies have absolutely nothing to do with a NICS background check delay, nor should they.

I've bought a lot of guns in the last five years, and about 1 in five were held up for a week longer than they should have been. The LGS I used had no real reason why, just that it was 'delayed'. So, I waited another week and it cleared. No biggie. My guess is that I just bought so many, one pistol a month for a year, and 4-5 rifles at a time, that my name and SSN was flagged, but thats just a guess on my part. In the end it didn't matter, I got what I paid for.

Thats what i was thinking as well. When I got my 03 FFL (C&R) all the hassles stopped.

I am not a betting man, but I would accept any wager that I could most likely find something in your past that would place a question in many peoples mind about your ability to own a gun.....oh, most righteous one.
