    Default Can I purchase a firearm since my restraining order has expired?

    6 years ago my now ex wife filed a restraining order in addition to the divorce. The restraining order was completely unfounded but of course the judge errs on the side of caution in these things (burden of proof on the 'abuser'!). Due to federal law I had to give up two family rifles after being served the papers =/
    There was no actual domestic violence, threat of violence, or any convictions with this restraining order. Since it expired 5 years ago can I legally get my rifles back, can I legally purchase another rifle? Thank you all in advance!

    you'll probably have to check your states laws.each one being different in these type things.

    I hope you hired a lawyer and went to the hearing to protest the restraining order. Too many men just don't show up and give up their rights.

    Best talk to a lawyer to see if it is possible to get your rights restored and your guns returned. I am sure you had a divorce lawyer to help you through your divorce. He/she is the one to consult. Not the internet!

    To ask for legal advice on the internet is a waste of time, in my opinion, since each location operates under different rules.

    In Oregon I don't think you can get that off your record.

    2. If there is not an active protective/restraining order against you and you don't have a family violence conviction during these times, you should have no problem buying guns again.

    You should of had you lawyer file a protest with the court when they were taken. You hurt your own cause by waiting so long. Good luck.
